BILL ANALYSIS C.S.H.B. 2754 By: Pitts (Armbrister) State Affairs 05-17-95 Senate Committee Report (Substituted) BACKGROUND Currently, there is no definition of portable buildings in reference to transportation laws. PURPOSE As proposed, C.S.H.B. 2754 defines "portable building unit" and sets forth the provisions regarding moving a portable building unit on a highway, roadway, or street. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Article 6701a-2, V.T.C.S., by adding Subsections H-J, as follows: H. (a) Requires a portable building unit that exceeds 16 feet, but is not more than 18 feet, in width to have one escort flag vehicle that must precede the portable building unit on a two-lane roadway, or follow the portable building unit on a roadway of four or more lanes. (b) Requires a portable building unit that exceeds 18 feet in width to have escort vehicles both preceding and following the unit while moving over a highway, road, or street in this state. (c) Sets forth the requirements of an escort flag vehicle. I. Provides that this article applies to transportation of a portable building unit regardless of whether it is transported as an assembled or partially assembled portable building or as unassembled modular building components. J. Defines "portable building unit." SECTION 2. Effective date: September 1, 1995. SECTION 3. Emergency clause.
