BILL ANALYSIS H.B. 2775 By: Serna 04-26-95 Committee Report (Unamended) BACKGROUND Under the present state law (Vernon's Texas Civil Statutes, Article 6701d, Section 5) and many city ordinances, an individual's vehicle may only be "booted" or impounded for three or more delinquent unpaid parking citations in any calendar year. This means, in effect, that one could receive a dozen parking citations in December, fail to set a hearing or pay the fine, and escape the consequences of the "boot" or impoundment should the police fail to locate the offender's vehicle by January 1. PURPOSE House Bill 2775 permits enforcement of a Hearing Officer's Orders by authorized personnel "booting" or impounding the offender's vehicle when there are three or more unpaid parking citations in any period of 12 consecutive months. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1: Amends Article 6701d-24, Section 5(1), Revised Statutes, by deleting the words "calendar year" and substituting therefore the words "period of 12 consecutive months." SECTION 2: Emergency Clause. The Chair laid out H.B. 2775 and recognized Representative Serna to explain H.B. 2775. There were no witnesses testifying in support of, or in opposition to H.B. 2775. The Chair left H.B. 2775 pending before the Committee. The Chair laid out H.B. 2775 by Serna, which was pending before the Committee. Representative Moreno moved that the Committee report H.B. 2775, without amendments, to the full House with the recommendation that it do pass.
