BACKGROUND

The pension plan provides for disability retirement benefits for
members injured in the line of duty regardless of length of service
and for members with non-duty related disabilities if they have in
excess of ten years of service.  However, language in the statutes
prohibits a member with excess of twenty years of service and is
disabled from being eligible to receive a disability retirement
benefit.

PURPOSE

Allow disabled members to apply for a disability benefit in lieu of
a service retirement if they have more than twenty years of
service.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly
grant any additional rulemaking authority to a state officer,
department, agency, or institution.

SECTION BY SECTION ANALYSIS

SECTION 1:  Amends Section 13(a), Police Officers' Pension System
in cities of 1,2000,000 or more, Article 6243g-3, V.T.C.S., by
deleting language excluding members who are eligible for a service
pension.  Amends Section 13(b) by deleting language excluding
members who are eligible for a service pension.

SECTION 2:  Emergency clause

SUMMARY OF COMMITTEE ACTION

April 12, 1995.
