BACKGROUND

The Police Officers' Pension System pension plan provides for
disability retirement benefits for members injured in the line of
duty regardless of length of service and for members with non-duty
related disabilities if they have in excess of 10 years of service. 
However, language in the statutes prohibits a member with excess of
20 years of service and is disabled from being eligible to receive
a disability benefit.

PURPOSE

As proposed, H.B. 2842 deletes a provision relating to the
eligibility for disability pensions for a member of a police
officers' retirement system not otherwise eligible for a service
pension.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not grant any
additional rulemaking authority to a state officer, institution, or
agency.

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 13, Article 6243g-3, V.T.C.S., as
follows:

     Sec. 13.  ELIGIBILITY FOR DISABILITY PENSION.  Requires a
     member of a police officers' retirement system, rather than a
     member not otherwise eligible for a service pension, who
     suffers a disability resulting from an act which would
     normally occur while employed as a police officer, to be
     eligible for a duty-connected disability pension.
     
     (b)  Makes a conforming change.
       
       SECTION 2.   Emergency clause.
           Effective date:  90 days after adjournment.
