BILL ANALYSIS H.B. 2873 By: Johnson 4-12-95 Committee Report (Unamended) BACKGROUND The Nacogdoches County Hospital District was created by a special act of the Legislature in 1967 under authority of Article 9, Section 9 of the Constitution. The Act was amended in 1977 and 1983. Also, the Act has been judicially altered by judgement of the United States District Court for the Eastern District of Texas. The board of Directors of the Nacogdoches County Hospital District have determined that amendments to the Act would be desirable for the residents of the District and would allow more efficient administration of the affairs of the District. PURPOSE To provide Nacogdoches County Hospital District with more efficient and effective administration. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 3, Chapter 431, Acts of the 60th Legislature, Regular Session, 1967 by deleting property taxpaying. SECTION 2. Amends Section 4, by adding: One director is elected from each commissioner precinct and three directors are elected at large. Directors serve staggered two-year terms. Outlines who is eligible to be director; length of a term; when a majority is needed for voting; and details for elections. SECTION 3. Amends Section 6, by adding resident and deleting property taxpayer. SECTION 4. Amends Section 7, by deleting: who own taxable property therein and who have duly rendered the same for taxation. Removes the words: Civil, of Texas, 1925, as amended. SECTION 5. Amends Section 10, by adding: $10,000 and refers to Subchapter B, Chapter 271, Local Government Code. SECTION 6. Amends Section 15, by deleting: and own real property subject to hospital district taxation. Makes reference to the Tax Code. SECTION 7. Amends Chapter 431, Acts of the 60th Legislature, Regular Session, 1967, by adding Sections 16(A) and 16 (E). Section 16A. The board may provide retirement benefits for employees of the district. Section 16B. The board may adopt rules governing the operation of the hospital. Section 16C. The board may contract out services. Section 16D. Registered voters outside the district may file a petition to become a part of the district. Section 16E. The board shall require reimbursement for care outside the district. SECTION 8.
