BILL ANALYSIS C.S.H.B. 2998 By: Oakley 03-30-95 Committee Report (Substituted) BACKGROUND The Kaufman County Juvenile Board currently consists of the county judge, the district judges in Kaufman County, and the criminal district attorney. Each member of the board lends specific knowledge, expertise, and familiarity with juvenile issues to the juvenile board. In the past, the county judge was the primary judge for juvenile cases; however, the county judge no longer hears juvenile cases. Therefore, to better serve the citizens of Kaufman County, it is important to include the County Court at Law for the Kaufman County Judge, the primary judge for juvenile cases, on the Kaufman County Juvenile Board. PURPOSE CSHB 2998 requires the Kaufman County Juvenile Board to be composed of the county judge, the judge of the County Court at Law of Kaufman County, the district judges in Kaufman County, and the criminal district attorney. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 152.1351(a), Human Resources Code, to add the judge of the County Court at Law of Kaufman County to the Kaufman County Juvenile Board. SECTION 2. Effective date: September 1, 1995. SECTION 3. Emergency clause. COMPARISON OF ORIGINAL TO SUBSTITUTE CSHB 2998 is a correction of improper drafting from the original version. SUMMARY OF COMMITTEE ACTION H.B. 2998 was considered by the committee in a public hearing on 29 March 1995. The committee considered a substitute to HB 2998 which was adopted without objection. The bill was reported favorably as substituted with the recommendation that it do pass and be printed and be sent to the Committee on Local and Consent Calendars by a record vote of 6 ayes, 0 nays, 0 pnv, 3 absent.
