BILL ANALYSIS C.S.H.B. 3017 By: Seidlits 05-02-95 Committee Report (Substituted) BACKGROUND Currently, fingerprinting for the purposes of identification has been a free sevice by law enforcement agencies or any political subdivision of the state. This law was passed in 1985 and since that time the volume of persons requesting this service has increased dramatically. PURPOSE This bill would allow an agency to charge for fingerprinting. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 80.001 (b), Human Resources Code to allow for law enforcement agencies to charge for fingerprinting. SECTION 2. Effective date SECTION 3. Emergency clause COMPARISON OF ORIGINAL TO SUBSTITUTE The substitute sets a cap of $10 on the fee that can be charged by the DPS. The substitute also adds an effective date and an emergency clause. SUMMARY OF COMMITTEE ACTION HB 3017 was considered by the committee in a public hearing on April 26, 1995. The committee considered a complete substitute for the bill. The substitute was adopted without objection. The bill was reported favorably as substituted with the recommendation that it do pass and be printed and be sent to Local and Consent Calendars, by a record vote of 8 ayes, 0 nays, 0 pnv, and 1 absent.
