BILL ANALYSIS H.B. 3017 By: Seidlits (sponsor) Criminal Justice 05-22-95 Senate Committee Report (Unamended) BACKGROUND Currently, fingerprinting for the purposes of identification is a free service by law enforcement agencies or any political subdivision of the state. PURPOSE As proposed, H.B. 3017 authorizes an agency to charge for fingerprinting. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 80.001(b), Human Resources Code, to authorize a law enforcement agency to charge a fee not to exceed $10 for the service provided under this section and to retain records of fingerprints made under this section. Deletes the provision prohibiting the law enforcement agency from retaining fingerprint records unless specifically requested to do so by the person requesting the service. SECTION 2. Effective date: September 1, 1995. SECTION 3. Emergency clause.
