BACKGROUND

Water Code Section 15.102(b) allows the Texas Water Development
Board to provide grants for economically distressed areas, defined
by statute as areas lacking adequate water service and not having
the financial resources available to provide such service.

PURPOSE

This bill would expand those eligible for grants under the
Economically Distressed Areas Program to include specific projects
identified through the legislative appropriations process.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly
grant any additional rulemaking authority to a state officer,
department, agency or institution.

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 15.102(b), Texas Water Code to allow the
loan fund to be used by the board to provide grants for projects
identified in legislative appropriations.

SECTION 2.  Emergency clause.  Effective date:  upon passage.

SUMMARY OF COMMITTEE ACTION

HB 3035 was considered in a full committee public hearing on April
5, 1995.  Louis Rosenberg, Bexar Metropolitan Water District
testified for the bill.  The bill was left pending.  HB 3035 was
taken up and considered again in a full committee public hearing on
April 12, 1995.  No witnesses testified on the bill.  The motion to
report the bill favorably to the Committee on Calendars carried by
a vote of 16 ayes, 1 nay, 0 PNV and 10 absent.
