BACKGROUND
Periodically, the Texas Legislature opts to alter the schedule of
agencies to be reviewed by the Sunset Advisory Commission in order
to balance the workload of the commission.
PURPOSE
CSHB 3052 amends the enabling statues of the Texas Commission on
Alcohol and Drug Abuse, the Texas Juvenile Probation Commission,
the Department of Protective and Regulatory Services and the Texas
Youth Commission to move forward their sunset review dates from
September 1, 1999 to 1997. It also moves forward the sunset date
of the Texas Incentive and Productivity Commission from September
1, 2001 to 1997. The bill also moves back the sunset dates of the
Criminal Justice Policy Council, the Texas Board of Criminal
Justice, the Texas Board of Criminal Justice, the Texas Department
of Criminal Justice, the Advisory Commission on State Emergency
Communications, the Council on Sex Offender Treatment, the Texas
Veterans' Commission and the Veterans' Land Board.
RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly
grant any additional rulemaking authority to a state officer,
department, agency or institution.
SECTION BY SECTION ANALYSIS
ARTICLE 1. 1997 AGENCIES
SECTION 1.01. Amends Sec. 461.004, Health and Safety Code.
Makes the sunset date of the Texas Commission on Alcohol and
Drug Abuse September 1, 1997, rather than 1999.
SECTION 1.02. Amends Sec. 2108.007, Government Code. Makes
the sunset date of the Texas Incentive and Productivity
Commission September 1, 1997, rather than 2001.
SECTION 1.03. Amends Sec. 141.012, Human Resources Code.
Makes the sunset date of the Texas Juvenile Probation
Commission September 1, 1997, rather than 1999.
SECTION 1.04. Amends Sec. 8, Art. 4413(503), Revised
Statutes. Makes the sunset date of the Department of
Protective and Regulatory Services September 1, 1997, rather
than 1999.
SECTION 1.05. Amends Sec. 61.020, Human Resources Code.
Makes the sunset date of the Texas Youth Commission September
1, 1997, rather than 1999.
ARTICLE 2. 1999 AGENCIES
SECTION 2.01. Amends Sec. 413.003, Government Code. Makes
the sunset date of the Criminal Justice Policy Council
September 1, 1999, rather than 1997.
SECTION 2.02. Amends Sec. 492.012, Government Code. Makes
the sunset date of the Texas Board of Criminal Justice and the
Texas Department of Criminal Justice September 1, 1999, rather
than 1997.
SECTION 2.03. Amends Subchapter B, Chapter 771, Health and
Safety Code. Makes the Advisory Commission on State Emergency
Communications subject to the Texas Sunset Act and establishes
a sunset date of September 1, 1999.
SECTION 2.04. Amends Section 14, Chapter 462, Acts of the
68th Legislature, Regular Session, 1983. Makes the sunset
date for the Council on Sex Offender Treatment September 1,
1999, rather than 1997.
SECTION 2.05. Amends Sec. 434.002(a), Government Code. Makes
the sunset date of the Texas Veterans Commission September 1,
1999, rather than 1997.
SECTION 2.06. Amends Sec. 161.0111, Natural Resources Code.
Makes the sunset date of the Veterans' Land Board September 1,
1999, rather than 1997.
ARTICLE 3. EFFECTIVE DATE; EMERGENCY
SECTION 3.01. Effective date: September 1, 1995.

COMPARISON OF ORIGINAL TO SUBSTITUTE
The filed bill only moves forward the sunset dates of the Texas
Commission on Alcohol and Drug Abuse, the Texas Juvenile Probation
Commission, the Department of Protective and Regulatory Services
and the Texas Youth Commission.
The substitute also moves forward the sunset date of the Texas
Incentive and Productivity Commission.
The substitute moves back the sunset dates of the Criminal Justice
Policy Council, the Texas Board of Criminal Justice, the Texas
Department of Criminal Justice, the Advisory Commission on State
Emergency Communications, the Council on Sex Offender Treatment,
the Texas Veterans' Commission and the Veterans' Land Board.
SUMMARY OF COMMITTEE ACTION
Pursuant to public notice posted on April 14, 1995, the Committee
on State Affairs convened in a public hearing on April 19, 1995 to
consider HB 3052. The Chair laid out HB 3052 and recognized Rep.
Junell to explain the bill. Rep. Black laid out a complete
committee substitute which was not adopted. The Chair recognized
Rep. Junell to close. The Chair left HB 3052 pending. In the same
public hearing on April 19, 1995, the Chair laid out HB 3052. Rep.
Black laid out a complete committee substitute which was adopted
without objection. The bill was reported favorably as substituted
with the recommendation that it do pass and be printed by a record
vote of 13 ayes, 0 nays, 0 pnv, 2 absent.
