BACKGROUND
The legislation enacting the Upper Colorado River Authority (UCRA)
was adopted in 1935.  Since that time, the UCRA's by-laws, as well
as the laws of the state, have changed significantly.  The UCRA's
enabling legislation has not changed concomitantly.

PURPOSE
HB 3053 updates Sections 3, 4, 5, and 6, Chapter 126, General Laws,
Acts of the 44th Legislature, Regular Session, 1935, to conform
with current practice.

RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly
grant any additional rulemaking authority to a state officer,
department, agency, or institution.

SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 3, 4, 5, and 6, Chapter 126, General
Laws, Acts of the 44th Legislature, Regular Session, 1935, as
follows:

     Sec.3.    (a) Removes prohibition on service as a district
director if a person has, during the preceding three years before
appointment, been employed by an electric power and light company,
gas company, telephone company, or any other utility company of any
kind or character whatsoever.

     (b)  Repeals provision providing $50.00 per diem pay.

     Sec.4.    Strikes all references to "General Manager" and
replaces them with "Chairman," pursuant to the district's by-laws.

     Sec.5.    Strikes all references to "General Manager" and
replaces them with "Chairman," pursuant to the district's by-laws.

     Sec.6.    Strikes all references to "General Manager" and
replaces them with "Chairman," pursuant to the district's by-laws;
strikes reference to the "Board of Water Engineers" and replaces it
with the "Texas Natural Resource Conservation Commission," pursuant
to current law.

SECTION 2. Emergency clause.


COMPARISON OF ORIGINAL TO SUBSTITUTE
The Original made changes to current law regarding the sale of
water to other political subdivisions, the subordination of all
water usage to the purpose of irrigation, the purchase of parks and
recreational land, the appointment of advisory boards, contract
amounts requiring ratification, and opening of district offices.
The Substitute does not change current law regarding any of that. 
The Substitute repeals the per diem pay language completely,
because Section 50.059, Water Code, provides for per diem pay of up
to $100.00.


SUMMARY OF COMMITTEE ACTION
H.B.3053 was considered by the committee in a public hearing on
April 18, 1995.
No testimony was received.
The committee considered a complete substitute for the bill.  The
substitute was adopted without objection.
The bill was reported favorably as substituted, with the
recommendation that it do pass and be printed and be sent to the
Committee on Local and Consent Calendars, by a record vote of 6
ayes, 0 nays, 0 pnv, 3 absent.
