BILL ANALYSIS H.B. 3116 By: Delisi et al. 03-28-95 Committee Report (Unamended) BACKGROUND The Medical Practice Act requires all persons registered to practice medicine in Texas to pay an annual registration fee in order to be licensed by the Texas Board of Medical Examiners. PURPOSE H.B. 3116 exempts a retired physician providing voluntary charity care from the annual registration fee. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 3.01(g) of the Medical Practice Act, (Article 4495b, Vernon's Texas Civil Statutes) by exempting retired physicians who only practice voluntary charity care from paying the annual registration fee. SECTION 2. Specifies that this applies to registration fees that are due on or after the effective date of this Act, and that fees due before the effective date are still due. SECTION 3. Emergency clause. Effective date: upon passage. SUMMARY OF COMMITTEE ACTION H.B. 3116 was considered by the Public Health Committee in a public hearing on March 28, 1995.
