BILL ANALYSIS H.B. 3192 By: Gray 4-24-95 Committee Report (Unamended) BACKGROUND The Gulf Coast Water Authority was created by the Legislature in 1965 by the 59th Legislature, Chapter 712. The Authority encompasses the entirety of Galveston County and serves 254,978 acres. The Authority is governed by seven board members appointed by the County Commissioners Court. Three of the members appointed by the Commissioners Court shall be registered professional engineers under the laws of Texas. PURPOSE To amend the Galveston County Commissioners Court's current method of appointing members to the Gulf Coast Water Authority. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS Section 1. Amends Sections 5, Chapter 712, Acts of the 59th Legislature, Regular Session. (a) Makes a nonsubstantive language change by creating subsections in existing language. (b) Deletes language requiring staggered terms for members of the Board of Directors of the Authority. (c) Requires the Commissioners Court of Galveston County to appoint two members to the Board of Directors to the Authority on its own initiative, two members on the recommendation of the Industrial Division Operating Advisory Committee, two members on the recommendation of the District's Mainland Division Operating Advisory Committee, which must include a representative of League City, and one member on the recommendation of the Galveston City Council; provides for terms of members of the Board of Directors. (d) Authorizes the Commissioners Court of Galveston County to accept or reject these recommendations. (e) Requires the District to certify the names of the members of the Industrial Division Operating Advisory Committee and the Mainland Division Advisory Committee to the Commissioners Court. Section 2. Repeals Section 5(a), Chapter 712, Acts of the 59th Legislature, Regular Session 1965. Section 3. Emergency clause.
