BACKGROUND

Section 152.0561, Human Resources Code, needs clarification to
bring it into accord with the existing structure of the Juvenile
Board of Coryell County.

PURPOSE

HB 3195, if enacted, conforms Section 152.0561 of the Human
Resources Code, which governs the Coryell County Juvenile Board,
with the existing structure of the Juvenile Board. It provides for
the selection of the Chairman of the Board by the members of the
Board, rather than assigning that duty to the District Court alone.
The bill also clarifies the compensation of members of the Juvenile
Board, and the powers of the Juvenile Board.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly
grant any additional rulemaking authority to a state officer,
department, agency or institution.

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 152.0561, Human Resources Code, to
include District Judges whose district includes Coryell County and
Coryell County Courts-at-Law Judges on the County Juvenile Board. 
Requires the board to designate one of its members to serve a one
or two year term as chairman and chief administrative officer. 
Requires the commissioners court to pay the board members equally
and not less than the amount paid to a board member as of October
1, 1994.  Authorizes the acceptance and use of gifts by the board
for the support of probation programs and services. Specifies which
sections of the Human Resources Code do not apply to the Coryell
County Juvenile Board.

SECTION 2.  Emergency clause.  Effective date: upon passage.

EXPLANATION OF AMENDMENTS

Committee Amendment #1 includes Coryell County District Judges and
Judges of the County Courts-at-Law on the Coryell County Juvenile
Board.

SUMMARY OF COMMITTEE ACTION

H.B. 3195 was considered in a public hearing on 19 April 1995.

One amendment was adopted without objection.  

H.B. 3195 was reported favorably as amended with the recommendation
that it do pass and be printed and be sent to the Committee on
Local and Consent Calendars, by a record vote of 5 ayes, 0 nays, 0
pnv, 4 absent.
