BACKGROUND

In 1977, the Montgomery County Hospital District was created.  The
Legislature used a typical arms-length practice of exempting
physicians from the Board of Directors. The present Board and many
members of the District are requesting that this restriction be
removed, as physicians would be of benefit to the Board.

PURPOSE

This bill amends Section 4(a), Chapter 258, Acts of the 65th
Legislature, Regular Session, to allow practicing physicians to
serve on the Montgomery County Hospital District Board of
Directors.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not grant any
additional rulemaking authority to a state officer, institution, or
agency.

SECTION BY SECTION ANALYSIS

Section 1. Section 4(a), Chapter 258, Acts of the 65th Legislature,
Regular Session, 1977, is amended as follows:

     (a) Remove the sentence: "No physician who has hospital
privileges in the District may     be a director; provided the
chief of staff may serve as an ex-officio director without the   right to vote as a member of the Board."

Section 2.  Emergency Clause.

SUMMARY OF COMMITTEE ACTION

HB 3198 was considered by the County Affairs Committee in a public
hearing on 5/3/95. HB 3198 was reported favorably with the
recommendation that it do pass and be printed and be sent to the
Committee on Local and Consent Calendars, by the record vote of 6
ayes, 0 nays, 0 pnv, 3 absent.
