BILL ANALYSIS H.B. 3198 By: Rabuck (Galloway) Intergovernmental Relations 05-17-95 Senate Committee Report (Unamended) BACKGROUND The Montgomery County Hospital District (district) was created in 1977. The legislature exempted physicians from the board of directors of the district. The present board and many members of the district are requesting that this restriction be removed. PURPOSE As proposed, H.B. 3198 deletes a provision restricting certain physicians from serving as a director of the board of the Montgomery County Hospital District. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 4(a), Chapter 258, Acts of the 65th Legislature, Regular Session, 1977, to delete a provision restricting a physician who has hospital privileges in the Montgomery Hospital District (district) from being a board director, provided that the chief of staff may serve as an ex officio director without the right to vote as a member of the board of the district. SECTION 2. Emergency clause. Effective date: upon passage.
