BILL ANALYSIS H.B. 3199 By: Swinford 04-29-95 Committee Report (Unamended) BACKGROUND The Government Code does not give specific authorization to the Secretary of State as it relates to delegated duties. The office of the Secretary of State could play an important role in furthering the interests of the state of Texas as it relates to NAFTA and border issues, including trade between Texas and Mexico. The office of the Secretary of State could be an effective liaison for the Governor. PURPOSE HB 3199 allows the Secretary of State to perform other duties at the direction of the Governor. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 405.117, Government Code by adding Subsection 6 as follows: (6) adds the phrase "perform such other and further duties as may be directed by the governor." SECTION 2. Effective date: September 1, 1995. SECTION 3. Emergency clause. SUMMARY OF COMMITTEE ACTION Pursuant to public notice posted on April 14, 1995, the Committee on State Affairs convened in a public hearing on April 19, 1995 to consider HB 3199. The Chair laid out HB 3199 and recognized Rep. Swinford to explain the bill. The Chair recognized Rep. Swinford to close. The Chair left HB 3199 pending. In a public hearing on April 24, 1995, the Chair laid out HB 3199. HB 3199 was reported favorably without amendment with the recommendation that it do pass and be printed and be sent to the Committee on Local and Consent Calendars which prevailed by a record vote of 13 ayes, 0 nays, 0 pnv, 2 absent.
