BILL ANALYSIS H.B. 3199 By: Swinford (Armbrister) State Affairs 5-22-95 Senate Committee Report (Unamended) BACKGROUND The Government Code does not give specific authorization to the secretary of state in terms of delegated duties. The office of the secretary of state may play an important role in furthering the interests of the state as a liaison for the governor in issues relating to NAFTA and the Texas-Mexico border, such as trade. PURPOSE As proposed, H.B. 3199 requires the secretary of state to perform such duties as may be directed by the governor. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 405.017, Government Code, by adding Subsection (6), to include in the list of miscellaneous duties of the secretary of state the requirement that the secretary of state perform such duties as may be directed by the governor. SECTION 2. Effective date: September 1, 1995. SECTION 3. Emergency clause.
