BACKGROUND

Currently, no municipal utility districts are represented on the
board of directors of the Harris-Galveston Coastal Subsidence
District.

PURPOSE

As proposed, H.B. 3215 expands the membership of the board of
directors of the Harris-Galveston Coastal Subsidence District to
include two representatives of municipal utility districts, one
appointed by the commissioners court of Harris County and the other
by the commissioners court of Galveston County.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not grant any
additional rulemaking authority to a state officer, institution, or
agency.

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Sections 151.031(a) and (b), Water Code, as
follows:

     (a) Provides that the Harris-Galveston Coastal Subsidence
     District (district) is governed by a board of directors
     composed of 19, rather than 17, members.
     
     (b) Provides that the board consists of, among others, three,
     rather than two, members appointed by the commissioners court
     of Harris County, one to be a representative of municipal
     utility districts, provided that the representative of
     municipal utility districts is a resident of a municipal
     utility district in the district; and three, rather than two,
     members appointed by the commissioners court of Galveston
     County, one to be a representative of municipal utility
     districts, provided that the representative of municipal
     utility districts is a resident of a municipal utility
     district in the district.
     
     SECTION 2.     (a) Requires the general manager of the district, not
later than the 30th day after the effective date of this Act, to
call and hold a meeting at the district's main office for the
selection of two additional directors added to the board of
directors of the district by this Act.  Requires the general manger
to mail notice of the time, place, and purpose of the meeting to
each commissioners court designated in Sections 151.031(b)(5) and
(6), Water Code, to choose the additional directors.  Requires the
notice to be sent by certified mail not later than the 10th day
before the date set for the meeting.

     (b) Provides that the initial new directors appointed under
     Sections 151.031(b)(5) and (6), Water Code, as amended by this
     Act, serve until January 31, 1996.  Sets forth requirements
     for the selection of subsequent directors.
     
     SECTION 3.     Emergency clause.
           Effective date: upon passage.
