BILL ANALYSIS H.B. 3216 By: Horn 05-02-95 Committee Report (Unamended) BACKGROUND The Upper Trinity Regional Water District was created during the 71st legislature in 1989. At that time, it included Denton County and the towns which border the county. At present, The City of Irving, located within Dallas County, wants to become a member of the water district, but due to the city's location, this requires further legislative action. PURPOSE To allow the City of Irving to be included within the Upper Trinity Regional Water District and balance the votes of the district's board of directors so as not to demonstrate bias towards one particular member. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 4(c), Chapter 1053, Acts of the 71st Legislature, to include the City of Irving of Dallas County within the boundaries of the Upper Trinity Regional Water District. SECTION 2. Amends Chapter 1053, Acts of the 71st Legislature, by adding Section 4A which allows for the inclusion of the City of Irving within the district's boundaries, if a contract is agreed upon between the City of Irving and the district within two years of the effective date. This contract also must be approved by a three-quarters majority of the district's board of directors. SECTION 3. Amends Section 7, Chapter 1053, Acts of the 71st Legislature by adding Subsection (g) which limits the possible number of weighted votes for which one director is eligible to vote in a capital project. SECTION 4. Validates all contracts, payments, and elections of the board of the Upper Trinity Regional Water District, as though they had been legally authorized. SECTION 5. Provides that Section 4 does not apply to any pending litigation to which the district is a party. SECTION 6. Emergency clause.
