BACKGROUND
Currently, Section 50.0241 of the Water Code requires the directors
of the Hudspeth County Underground Water Conservation District No.
1 to be elected to staggered, two year terms.  This requires the
county to hold elections every two years.  The board of directors
would like to have elections every four years.  This would save the
district money by not having to hold such frequent elections.

PURPOSE
To allow the Hudspeth County Underground Water Conservation
District No. 1 to hold at large elections of the board of directors
every four years; consequently, the board members will serve four
year terms.

RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly
grant any additional rulemaking authority to a state officer,
department, agency, or institution.

SECTION BY SECTION ANALYSIS
Section 1.  Amends Section 50.0241 of the Water Code, by requiring
the Hudspeth County Underground Water Conservation District No. 1,
at the first regularly held elections after the effective date of
this act, to fill vacant positions of the board by election for
two-year terms.  At the second regular election of directors
following the effective date of this act, all directors will be
elected to serve four year terms.  All subsequent elections of
directors will be held every four years.

Section 2.  Provides that notwithstanding Section 52.102 of the
Water Code, the directors of the Hudspeth County Underground Water
Conservation District No. 1 shall be elected from the district at
large.

Section 3.  Emergency clause.

SUMMARY OF COMMITTEE ACTION
H.B. 3234 was considered by the committee in a formal meeting on
May 3, 1995.
No testimony was received.

recommendation that it do pass and be printed and be sent to the
Committee on Local and Consent Calendars, by a record vote of 8
