BACKGROUND

     H.B. 1382 by Oakley proposes that a person who will be 18
years of age before the general election for state and county
officers be allowed to vote in the preceding primary election. 
This joint resolution will amend the Texas Constitution to allow
them to vote.

PURPOSE

     As proposed, HJR 130 allows persons who will be 18 years of
age or older on the date of the general election for state and
county officers to vote in the preceding primary election.

RULEMAKING AUTHORITY

     It is the committee's opinion that this bill does not
expressly grant any additional rulemaking authority to a state
officer, department, agency or institution.

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Article VI of the Texas Constitution by adding
Section 1a as follows:

     Sec. 1a.  The legislature by general law may provide for
     voting in a primary election by a person who:
           (1)  will be 18 years of age or older on the
           date of the subsequent general election for
           state and county officers; and
           (2)  satisfies the other applicable
           requirements for eligibility to vote.

SECTION 2.  Provides for the proposed constitutional amendment to
be submitted to the voters at an election to be held November 7,
1995.  Requires the proposition on the ballot to read as follows:

     The constitutional amendment authorizing a person who
     will be 18 years of age or older on the date of the
     general election for the state and county officers to
     vote in the preceding primary election.

SUMMARY OF COMMITTEE ACTION

     HJR 130 was considered by the Committee on Elections in a
public hearing on April 26, 1995.  The following persons testified
against HJR 130: Mary Ann Collins representing herself; and Sue
Daniel representing the County Clerk's Legislative Committee of the
County and District Clerk's Association of Texas.  HJR 130 was
reported favorably without amendment, with the recommendation that
it do pass and be printed by a record vote of: 5 AYES, 2 NAYS, 0
PNV, 2 ABSENT.
