BACKGROUND

In Panola County, overlapping jurisdiction between the Panola
County Court at Law and district court has caused confusion for
those conducting business before the court.

PURPOSE

As proposed, C.S.S.B. 34 clarifies the jurisdiction of the Panola
County courts by transferring all cases pending in the Panola
County Court at Law over which the district court has jurisdiction
to the district court.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not grant any
additional rulemaking authority to a state officer, institution, or
agency.

SECTION BY SECTION ANALYSIS

SECTION 1. Repealer:  Section 25.1852(a), Government Code (relating
to providing concurrent jurisdiction between the Panola County
Court at Law and the district court), effective January 1, 1996.

SECTION 2. (a) Requires the judge of the Panola County Court at Law
to transfer all cases pending in the court over which the court no
longer has jurisdiction because of the repeal of Section
25.1852(a), Government Code, to the district court.

     (b) Provides that all processes, writs, bonds, recognizances,
     or other obligations issued from the transferring court are
     returnable to the court to which the case is transferred. 
     Requires the obligees and all witnesses summoned to appear
     before a court from which a case is transferred to appear
     before the court to which the case is transferred as if
     originally required to appear before that court.
SECTION 3. Amends Section 25.1852(i), Government Code, to require
the amount paid to a special judge for a county court at law to be
deducted, rather than prohibiting the amount from being deducted,
from the salary of a regular judge. 

SECTION 4. Effective date: September 1, 1995.

SECTION 5. Emergency clause.
