BILL ANALYSIS C.S.S.B. 36 By: Brown Criminal Justice 3-22-95 Committee Report (Substituted) BACKGROUND The Sex Offender Registry was created to identify sex offenders, share information on known sex offenders throughout law enforcement, and track the offenders existence through the utilization of the registration. Currently, the majority of sex offenders are unregistered due to certain provisions in the law. PURPOSE As proposed, C.S.S.B. 36 requires sexual offenders to register the intended or current domicile to the local law enforcement authority prior to or immediately following release or relocation. RULEMAKING AUTHORITY It is the committee's opinion that rulemaking authority is granted to the Texas Department of Public Safety in SECTION 7 (Section 10(a), Article 6252-13c.1, V.T.C.S.) of this bill. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 2, Article 6252-13c.1, V.T.C.S., by amending Subsections (a) and (b), and by adding Subsections (d) and (e), as follows: (a) Requires a person who has a reportable conviction or adjudication to register or verify registration not later than the seventh day after arrival in a municipality or county. Makes conforming changes. (b) Requires the Texas Department of Public Safety to provide the Texas Department of Criminal Justice, the Texas Youth Commission, the Texas Juvenile Probation Commission and each local law enforcement authority and court with a form for registering persons who are required to do so. Sets forth the required contents of the form. (d) Requires the court to inform the person of his or her duty to register, complete the registration form and send it to the appropriate law enforcement agency. SECTION 2. Amends Section 9, Article 6252-13c.1, V.T.C.S., as follows: Sec. 9. EXPIRATION OF DUTY TO REGISTER. (a) Provides that the duty to register for a person with a reportable adjudication, other than violation of Sections 21.11(a)(1), 22.021, or 43.25, Penal Code, ends on the person's 26th birthday. (b) Provides that the duty for a person to register other than violations listed in Subsection (a) ends on the fifth anniversary of the date the person discharges parole or community supervision. (c) Makes conforming changes. SECTION 3. Makes application of this Act prospective. SECTION 4. Effective date: September 1, 1995. SECTION 5. Emergency clause.
