BILL ANALYSIS S.B. 89 By: Zaffirini Health and Human Services 1-25-95 Committee Report (Unamended) BACKGROUND Currently, all two-year terms of executive committee members of the Office for the Prevention of Development Disabilities will expire on February 1. Critics argue that with no overlapping members, the committee has little continuity of effort and experience. PURPOSE As proposed, S.B. 89 provides for staggered six-year terms for the members of the executive committee of the Office for the Prevention of Developmental Disabilities. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 112.045(c), Human Resources Code, to provide that the members of the executive committee of the Office for the Prevention of Developmental Disabilities serve for staggered six-year terms, rather than two year terms, with the terms of three members expiring February 1 of each odd-numbered year. SECTION 2. Provides that all terms of the current members expire on the effective date of this Act. Sets forth procedure for appointment following effective date. Provides that a member of the executive committee serving immediately before the effective date is eligible for reappointment. SECTION 3. Effective date: September 1, 1995. SECTION 4. Emergency clause.
