BACKGROUND

State law requires that a contract change order of any amount above
$15,000 be approved by the city council. Gaining approval from the
council is a lengthy process which causes a delay in contractors
receiving funds.

PURPOSE

As proposed, S.B. 99 authorizes the administrative official of a
municipality to approve construction change orders involving a
decrease or increase of $25,000.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not grant any
additional rulemaking authority to a state officer, institution, or
agency.

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Chapter 252C, Section 252.048(c), Local
Government Code, to grant authority to a municipality official to
approve construction change orders involving a decrease or increase
of $25,000 or less, rather than $15,000 or less.

SECTION 2. Effective date: September 1, 1995.

SECTION 3. Emergency clause.

SUMMARY OF COMMITTEE ACTION

S.B. 99 was considered by the committee in public hearing on
February 27, 1995 and was subsequently left pending.  It was taken
up on March 6, 1995.  The following person testified in favor of
the bill: Representative Giddings; Larry Casto, representing the
City of Dallas. The bill was reported favorably, without amendment, 
with the recommendation that it do pass and be printed, by a record
vote of 8 ayes, 0 nays, 0 pnv, and 1 absent.
