BILL ANALYSIS S.B. 114 By: Rosson Finance 01-26-95 Committee Report (Unamended) BACKGROUND H.B. 1356, from the 73rd Legislature, created a new exemption from tuition under certain circumstances. The author of the bill claims that a provision which requires veterans and children of veterans to show proof of financial aid to qualify for tuition exemptions was unintentional. Currently, because of pending opinions from the attorney general, the statutory changes made by H.B. 1356 are not being enforced. PURPOSE As proposed, S.B. 114 provides that certain military-related persons and surviving children of certain members of the armed forces are not required to demonstrate financial need in order to be exempt from the fees of a public institution of higher learning. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Sections 54.203(a) and (b), Education Code, to delete the demonstration of financial need from the requirements necessary for an exemption from payment of dues, fees and charges of a public institution of higher education for certain veterans, surviving children of certain members of the armed forces, and other military-related persons. SECTION 2. Provides that this Act applies to tuition, fees, and charges beginning with the fall semester 1995. SECTION 3. Emergency clause. Effective date: upon passage.
