BILL ANALYSIS S.B. 146 By: West Criminal Justice 3-15-95 Committee Report (Amended) BACKGROUND Article 42.13, Section 3(a)(4), Code of Criminal Procedure, presently provides that the Community Justice Council of each jurisdiction be composed of two legislators elected from the county to be served by the Texas Department of Criminal Justice, chosen by the state legislator elected from the counties to be served by the department. PURPOSE As proposed, S.B. 146 limits a community justice council to membership by one senator and one representative, rather than any two legislators. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 3(a), Article 42.131, Code of Criminal Procedure, to provide that more than one state senator and one state representative, rather than any two legislators, are authorized to serve on a community justice council in a county with a population of one million or more to be served by the Texas Department of Criminal Justice. SECTION 2. Emergency clause. Effective date: upon passage.
