BACKGROUND

The Compensation to Victims of Crime Fund and the Compensation to
Victims of Crime Auxiliary Fund were established to reimburse
certain victims of violent offenses for their crime-related
expenses.  The payments made to these victims are financed by fines
collected from the offenders.  Currently, both funds are
consolidated with the General Revenue Fund.

PURPOSE

As proposed, S.B. 217 provides that Section 403.095, Government
Code, does not apply to compensation to victims of crime fund or
auxiliary fund.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not grant any
additional rulemaking authority to a state officer, institution, or
agency.

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 56.54, Code of Criminal Procedure, by
adding Subsection (h), to provide that Section 403.095, Government
Code, does not apply to the compensation to victims of crime fund
or the compensation to victims of crime auxiliary fund.

SECTION 2.  Effective date: September 1, 1995.

SECTION 3.  Emergency clause.
