BILL ANALYSIS C.S.S.B. 218 By: Armbrister State Affairs 5-5-95 Committee Report (Substituted) BACKGROUND Some members of the Texas fire service feel that the Texas Commission on Fire Protection has had problems since its creation by the 72nd Legislature. Some of the difficulties with the commission were addressed by the 73rd Legislature and agreed to by all organizations representing the Texas fire service. Officials of the organizations believe that major changes may be addressed when the commission goes through the complete Sunset process prior to the 75th legislative session. PURPOSE As proposed, C.S.S.B. 218 requires the Texas Commission on Fire Protection (commission) to adopt, reject, or take no action on the recommendations of the Fire Protection Personnel Advisory Committee. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 419.023(c), Government Code, to require the Texas Commission on Fire Protection (commission) to adopt, reject, or take no action on the recommendations of the Fire Protection Personnel Advisory Committee (committee) during the first meeting at which the commission considers any committee recommendations. Authorizes the commission to adopt, modify and adopt, or reject the recommendations made by the committee. Makes conforming changes. SECTION 2. Amends Section 419.072(c), Government Code, to make conforming changes. SECTION 3. Amends Section 417.0041(b), Government Code, to make conforming changes. SECTION 4. Emergency clause. Effective date: 90 days after adjournment.
