BILL ANALYSIS S.B. 228 By: Patterson Criminal Justice 3-22-95 Committee Report (Unamended) BACKGROUND Currently, under Section 51.09, Family Code, a juvenile and his or her attorney have the sole right to waive a jury trial in a juvenile proceeding. PURPOSE As proposed, S.B. 228 requires a court to order trial by jury if requested by the prosecuting attorney. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 54.03(c), Family Code, to require a court to order a trial by jury if requested by the prosecuting attorney even though jury has been waived in accordance with Section 51.09, Family Code. SECTION 2. Effective date: September 1, 1995. SECTION 3. Makes application of this Act prospective. SECTION 4. Emergency clause.
