BACKGROUND

In October 1988, the Baylor Department of Public Safety (DPS) was
approved to operate as a campus police agency by the Texas
Commission on Law Enforcement Officer Standards and Education.  The
73rd Legislature, Regular Session, while amending certain sections
of the Education Code, inadvertently decommissioned the Baylor
Medical School DPS.  Currently, Baylor has an emergency interim
agreement with the Dallas County Commissioners Court in order to
continue to provide police services.

PURPOSE

As proposed, S.B. 238 recreates the authority of the Baylor
University Medical Center to employ a campus law enforcement
agency.

RULEMAKING AUTHORITY

It is the opinion of the committee that this bill does not
expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution.

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends 51.214, Education Code, as follows:
Sec. 51.214.  New title: SECURITY OFFICERS FOR MEDICAL CORPORATIONS
IN CERTAIN MUNICIPALITIES.  (a)  Authorizes the governing board of
a private nonprofit medical corporation that provides security
services for an institution of higher education or private
postsecondary educational institution and other entities located
within the same medical complex in a municipality with a population
of 1,000,000 or more, to employ and commission security personnel
to enforce state law at the medical complex and its branches.

SECTION 2.  Emergency clause.  Effective date: upon passage.

SUMMARY OF COMMITTEE ACTION

S.B. 238 was considered by the Committee on Public Safety in a
public hearing on February 28, 1995.

Center.
The bill was reported favorably without amendment, with the
recommendation that it do pass and be printed, by a record vote of
8 ayes, 0 nays, 0 pnv, 1 absent.
