BILL ANALYSIS S.B. 258 By: Wentworth State Affairs 01-30-95 Committee Report (Unamended) BACKGROUND The Alcoholic Beverage Code includes a provision authorizing the Texas Alcoholic Beverage Commission to approve training programs for persons who sell, service, dispense, or deliver alcoholic beverages. One of the primary purposes of these training programs is to educate sellers about the laws pertaining to sale of alcoholic beverages to minors or intoxicated persons, including effective approaches to intervening with persons who are clearly intoxicated. Under current law, the commission is not required to approve acceptable seller training programs at four-year institutions of higher learning. PURPOSE As proposed, S.B. 258 provides that the Texas Alcoholic Beverage Commission must accept alcoholic beverage seller training programs from certain institutions of higher education, provided the program meets the commission's standards. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 106.14(b), Alcoholic Beverage Code, to require the Texas Alcoholic Beverage Commission to approve seller training programs meeting certain requirements sponsored by public or private institutions of higher education that offer a four-year undergraduate program and a degree or certificate in hotel management, restaurant management, or travel or tourism management, in addition to those sponsored privately or by public community colleges. SECTION 2. Effective date: September 1, 1995. SECTION 3. Emergency clause.
