BACKGROUND

Henry G. "Bud" Lehman was born in Lee County, Texas on January 15,
1910.  He was elected to the 45th Legislature in 1937 and served
through the 54th Legislature in 1957.  At that time, he was the
youngest dean in the history of the Texas House of Representatives
and served the longest consecutive term.  During his 20-year term,
Bud worked to improve the rural roads of Texas.  In addition, he
actively pursued an adequate farm to market system of rural
roadways and was co-sponsor of the Colson/Briscoe Bill, working
diligently for its passage.

Designating a memorial highway can only be accomplished by the
legislature or a local government.  The procedures are explained in
Article 6673e-4, V.T.C.S.

PURPOSE

As proposed, S.B. 318 designates United States Highway 290 in Lee
County as Henry G. "Bud" Lehman Highway.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not grant any
additional rulemaking authority to a state officer, institution, or
agency.

SECTION BY SECTION ANALYSIS

SECTION 1.  Designates United States Highway 290 in Lee County as
Henry G. "Bud" Lehman Highway.

SECTION 2. (a) Requires the Texas Department of Transportation to
design and construct markers to be placed along U.S. 290 in Lee
County indicating its designation as the Henry G. "Bud" Lehman
Highway.

     (b) Requires the markers to include the highway number and any
     other information that the department determines is
     appropriate.
     
     (c) Requires markers to be erected at each point along the
     highway at which the highway enters Lee County and at
     intermediate sites that the department determines are
     appropriate.
     
     (d) Provides that the department is responsible for repair and
     replacement of the markers and for maintenance of the grounds
     surrounding each marker.
     
     (e) Authorizes the department to accept grants and donations
     from individuals and other entities to assist in financing the
     construction and maintenance of the markers.
SECTION 3. Emergency clause.
           Effective date: upon passage.
