BILL ANALYSIS S.B. 319 By: Armbrister February 22, 1995 Committee Report (Amended) BACKGROUND The State of Texas is in the process of making nonsubstantive revisions to and recodifying its statutes. PURPOSE As proposed, S.B. 319 recodifies and makes nonsubstantive revisions to the Public Utility Regulatory Act, including conforming amendments, repealers, and penalties. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Recodifies and makes nonsubstantive revisions to the Public Utility Regulatory Act of 1955, including conforming amendments, repealers, and penalties. SECTION 2. Repealer: Article 1446c, V.T.C.S. (Public Utility Regulatory Act). Makes nonsubstantive changes. SECTION 3. States that this act is a nonsubstantive revision of PURA, and is subject to the applicaple provisions of the law relating to the interperatation of nonsubstantive revisions of law. SECTION 4. Emergency clause. Effective date: upon passage. EXPLANATION OF AMENDMENTS Committee amendment #1 is a nonsubstantive amendment to SB 319 to ensure that the definition of "public utility" stays the same as current source law. Makes conforming changes. SUMMARY OF COMMITTEE ACTION Pursuant to notice posted on February 15, 1995, the Committee on State Affairs convened in a public hearing on February 20, 1995 to consider SB 319. The Chair laid out SB 319. Neutral testimony on the bill was received from Carolyn Hall representing the Texas Legislative Council and Martin Wilson representing the Public Utility Commission of Texas. Rep. Seidlits offered committee amendment #1 which was adopted without objection. The motion to report SB 319 favorably as amended prevailed by a vote of 15 Ayes, 0 Nay, 0 PNV and 0 Absent.
