BILL ANALYSIS S.B. 320 By: Shapiro Jurisprudence 02-07-95 Committee Report (Unamended) BACKGROUND The Collin County Commissioners Court voted to ask the 74th Legislature to create an additional court at law for Collin County, expand the probate jurisdiction of the county's courts at law and renumber the existing courts at law. PURPOSE As proposed, S.B. 320 creates County Courts at Law No. 1 and 2 of Collin County and grants probate jurisdiction to a county court at law in Collin County. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 25.0451, Government Code, to create County Courts at Law No. 1 and 2 of Collin County. SECTION 2. Amends Section 25.0452, Government Code, to provide that a county court in Collin County has probate jurisdiction, in addition to the jurisdiction provided by Section 25.0003 and other law. SECTION 3. Provides that the County Court at Law No. 4 of Collin County is created as of October 1, 1995, or on an earlier date determined by the commissioners court. SECTION 4. Effective date: September 1, 1995. SECTION 5. Emergency clause.
