BILL ANALYSIS S.B. 361 By: Armbrister Natural Resources 03-01-95 Committee Report (Unamended) BACKGROUND The Guadalupe-Blanco River Authority (GBRA) was created by the Texas Legislature in 1935 to develop, conserve, and protect the waters of the Guadalupe River Basin. In 1989, the 71st Legislature gave the Texas Natural Resource Conservation Commission, then the Texas Water Commission, increased responsibility and oversight of the GBRA and the state's other river authorities. The legislature removed the Sunset review at that same time. In 1993, the legislature identified problems with the GBRA's management and placed the authority under Sunset review. Under this provision, the terms of the GBRA board members expire September 1, 1995, unless the legislature continues the authority. PURPOSE As proposed, S.B. 361 repeals Section 3.03, Chapter 626, Acts of the 73rd Legislature, 1993, relating to the removal of the Guadalupe-Blanco River Authority from the application of the Texas Sunset Act. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Repealer: Section 3.03, Chapter 626, Acts of the 73rd Legislature, 1993 (Sunset Commission Review of Guadalupe-Blanco River Authority). SECTION 2. Effective date: September 1, 1995. SECTION 3. Emergency clause.
