BACKGROUND

Periodically, the Texas Legislature alters the schedule of agencies
subject to review by the Sunset Advisory Commission in order to
balance the workload of the commission.

PURPOSE

As proposed, C.S.S.B. 374 moves the dates of certain state agencies
which are subject to the Texas Sunset Act in 1999, to September 1,
1997.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not grant any
additional rulemaking authority to a state officer, institution, or
agency.

SECTION BY SECTION ANALYSIS

                    ARTICLE 1.  1997 AGENCIES

SECTION 1.01.  Amends Section 461.004, Health and Safety Code, to
move the date the Commission on Alcohol and Drug Abuse is
abolished, unless continued in existence as provided by this
chapter, from September 1, 1999, to September 1, 1997.

SECTION 1.02.  Amends Section 141.012, Human Resources Code, to
move the date the Texas Juvenile Probation Commission is abolished,
unless continued in existence as provided by this chapter, from
September 1, 1999, to September 1, 1997. 

SECTION 1.03.  Amends Section 8, Article 4413(503), V.T.C.S., to
move the date the Department of Protective and Regulatory Services
is abolished, unless continued in existence as provided by this
chapter, from September 1, 1999, to September 1, 1997. 

SECTION 1.04.  Amends Section 61.020, Human Resources Code, to move
the date the Texas Youth Commission is abolished, unless continued
in existence as provided by this chapter, from September 1, 1999,
to September 1, 1997. 

                     ARTICLE 2. 1999 AGENCIES

SECTION 2.01.  Amends Chapter 771B, Health and Safety Code, by
adding Section 771.032, to move the date the Advisory Board on
State Emergency Communications is abolished, unless continued in
existence as provided by this chapter, from September 1, 1997, to
September 1, 1999.

SECTION 2.02.  Amends Section 14, Article 4413(51), V.T.C.S., to
move the date the Council on Sex Offender Treatment is abolished,
unless continued in existence as provided by this chapter, from
September 1, 1997, to September 1, 1999.
SECTION 2.03.  Amends Section 434.002(a), Government Code, to move
the date the Texas Veterans Commission is abolished, unless
continued in existence as provided by this chapter, from September
1, 1997, to September 1, 1999.

SECTION 2.04.  Amends Section 161.0111, Natural Resources Code, to
move the date the Veterans' Land Board is reviewed, from 1997, to
1999.

SECTION 2.05.  Amends Section 2108.007, Government Code, to move
the date the Texas Incentive and Productivity Commission is
abolished unless continued in existence as provided by this
chapter, from September 1, 2001, to September 1, 1999.

             ARTICLE 3.  EFFECTIVE DATE; EMERGENCY

SECTION 3.01.  Effective date: September 1, 1995.

SECTION 3.02.  Emergency clause.

SUMMARY OF COMMITTEE ACTION

SB 374 was considered by the Committee on State Affairs in a public
hearing on May 16, 1995.  The Chair laid out SB 374.  The bill was
reported favorably without amendment, with the recommendation that
it do pass and be printed, by a record vote of: 9 ayes; 0 nays; 0
pnv; and 6 absent.
