BILL ANALYSIS S.B. 524 By: Lucio Economic Development 03-08-95 Committee Report (Unamended) BACKGROUND The Marine Military Academy is a nonprofit organization affiliated with the U.S. Marine Corps to educate students from eighth through twelfth grades. Current Texas law does not give limited liability to the academy as it does to other nonprofit organizations. This subjects the Marine Military Academy to much higher liability than other organizations of the same status. PURPOSE As proposed, S.B. 524 adds military schools to the definition of "charitable organization." RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 84.003(1), Civil Practice and Remedies Code, to redefine "charitable organization" by adding to the list a primary or secondary school that is exempt from federal income tax under Section 501(a) of the Internal Revenue Code of 1986, operates a boarding school only and does not provide educational services to students other than those boarding, and offers a curriculum in conjunction with the U.S. Marine Corps Junior Officer Training Corps. SECTION 2. Effective date: September 1, 1995. Makes application of this Act prospective. SECTION 3. Emergency clause.
