BILL ANALYSIS S.B. 561 By: Sibley Intergovernmental Relations 2-22-95 Committee Report (Unamended) BACKGROUND Jack County currently has a hospital district whose members are appointed by the commissioners court. PURPOSE As proposed, S.B. 561 provides for a five-member board of directors of the Jack County Hospital District whose members serve staggered terms of two years and are elected by place. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 4.01, Chapter 16, Acts of the 70th Legislature, Regular Session, 1987, as follows: Sec. 4.01. New heading: BOARD OF DIRECTORS; ELECTION. (a) Provides that members of the board of directors of the Jack County Hospital District are elected at large by place. (b) Provides that a board member's term begins on June 1 following the date the member is elected. Deletes requirements of the commissioners court. (c) Requires a director's election to be held on the first Saturday in May of each year to elect the appropriate number of succesor directors. Deletes existing subsection. SECTION 2. Amends Section 4.02, Chapter 16, Acts of the 70th Legislature, Regular Session, 1987, to set forth eligibility requirements to be a candidate for or to serve as a director of the board. SECTION 3. Amends Section 4.04, Chapter 16, Acts of the 70th Legislature, Regular Session, 1987, to require a vacancy in the office of director to be filled for the unexpired term by appointment by the remaining directors, rather than the commissioners court of Jack County. SECTION 4. (a) Effective date: September 1, 1995. Requires the first election of the Jack County Hospital District board of directors to be held May 4, 1996. Provides that this section applies to the first two elections of directors. (b) Requires the board to designate the positions of the directors serving in offices for staffer (c) Requires directors to be elected for Place 1, Place 3, and Place 5 for terms expiring June 1, 1998, at the first election for directors under this Act. Provides that the terms of office for appointed directors serving in those places expire on the date the elected directors qualify for office. (d) Requires directors to be elected for Place 2 and Place 4 for terms expiring June 1, 1999, at the second election for directors under this Act. Makes a conforming change. SECTION 5. Emergency clause.
