BACKGROUND

The Comptroller's Office conducted a comprehensive disparity study
of state agency procurement and contracting with historically
underutilized businesses (HUBs).  The study's findings suggest and
provide objective bases for the General Services Commission and
other agencies to modify their HUB purchasing policies.

PURPOSE

As proposed, S.B. 618 requires a report prepared by the General
Services Commission to contain certain information regarding
historically underutilized businesses program.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not grant any
additional rulemaking authority to a state officer, institution, or
agency.

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 1.03(c), Article 601b, V.T.C.S. (State
Purchasing and General Services Act), as follows:

     (c)  Requires a report based on a compilation of non-treasury
     and subcontracting data  prepared by the General Services
     Commission (commission) to include for each state agency the
     total number of historically underutilized businesses (HUBs)
     certified by the commission that were paid by the agency or by
     a contractor under a contract with the agency and the dollar
     amount of payments that were made by the agency or by a
     contractor under a contract with the agency to certified HUBs. 
     Authorizes the commission to require information from a state
     agency that the commission considers necessary to administer
     this section.  Authorizes the commission to require that
     information about a state agency contract without regard to
     the source of funds for the contract, whether the contract is
     made by an agency acting under delegated purchasing authority
     or under an exception to the commission's purchasing
     authority, or whether the contract is made under the authority
     of this Act or other law.  Authorizes the commission to adopt
     rules to administer this section.
     
     SECTION 2.     Emergency clause.
           Effective date: upon passage.
