BILL ANALYSIS S.B. 805 By: Gallegos Health and Human Services 4-6-95 Committee Report (Unamended) BACKGROUND Current law requires persons who operate a child-care facility or child-placing agency to obtain a license, which includes payment of an application fee, from the Texas Department of Human Services. Some nonprofit groups that offer annual youth camps have been forced to charge fees to cover costs. PURPOSE As proposed, S.B. 805 expands the list of entities exempted from child-care licensing requirements. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 42.041(b), Human Resources Code, as follows: (b) Provides that this section does not apply to an annual youth camp, in a municipality of more than 1.5 million people, that operates for not more than three months and that has been operated for at least 10 years by a nonprofit organization providing care to the homeless. SECTION 2. Effective date: September 1, 1995. SECTION 3. Emergency clause.
