BILL ANALYSIS S.B. 813 By: Henderson State Affairs 4-22-95 Committee Report (Unamended) BACKGROUND Currently, full-time peace officers who perform part-time security work are exempt from the requirement of obtaining a private security license under Article 4413(29bb), V.T.C.S. The term "full-time employment," however, is not adequately defined. Currently, little or no regulation is placed upon security personnel. PURPOSE As proposed, S.B. 813 defines "peace officer" and grants persons qualifying as peace officers an exemption from the provisions of this Act. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 2, Article 4413(29bb), V.T.C.S. (Private Investigators and Private Security Agencies Act), by adding Subdivision (34), to define "peace officer." SECTION 2. Amends Section 3(a), Article 4413(29bb), V.T.C.S., to exempt from this Act persons who work as peace officers on the average of at least 32 hours a week, is compensated by the state or a political subdivision of the state at the rate of the minimum wage or higher, and is entitled to all employee benefits offered to a peace officer by the state or political subdivision. Makes conforming changes. SECTION 3. Effective date: September 1, 1995. SECTION 4. Emergency clause.
