BILL ANALYSIS S.B. 888 By: Sibley (Munoz) 05-04-95 Committee Report (Unamended) BACKGROUND Currently, if a person wants to construct an off-premises sign which is visible from a rural road, the person must register the sign with the Texas Department of Transportation and pay a non-refundable fee. Political signs which are erected 60 days before an election are exempt from this registration requirement. PURPOSE As proposed, S.B. 888 exempts from the regulation of outdoor signs on rural roads a sign erected solely for and relating to a public election if the sign is erected no sooner than the 90th day before the election and is removed no later than the 10th day after the election. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 12(a), Article 6674v-3, V.T.C.S., to exempt from the regulation of outdoor signs on rural roads a sign erected solely for and relating to a public election if the sign is erected no sooner than the 90th, rather than the 60th, day before the election and is removed no later than the 10th day after the election. SECTION 2. Emergency clause. Effective date: upon passage. SUMMARY OF COMMITTEE ACTION SB 888 was considered by the Committee on Elections in a public hearing on May 3, 1995. SB 888 was reported favorably without amendment, with the recommendation that it do pass and be printed and be sent to the Committee on Local and Consent Calendars, by a record vote of: 7 AYES, 0 NAYS, 1 PNV, 1 ABSENT.
