BACKGROUND

Currently, a motor vehicle left inoperable or unattended on a
county, state or federal highway is not considered "abandoned" and
subject to removal by police agencies until after 48 hours.

PURPOSE

As proposed, S.B. 896 redefines "abandoned motor vehicle," to
include vehicles unattended for more than 12 hours on a controlled
access highway.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not grant any
additional rulemaking authority to a state officer, institution, or
agency.

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 5.01(2), Article 4477-9a, V.T.C.S., to
redefine "abandoned motor vehicle" by including a vehicle which is
unattended for more than 12 hours on a controlled access highway,
as defined by Section 13, Article 6701d, V.T.C.S.

SECTION 2. Makes application of this Act prospective.

SECTION 3. Effective date: September 1, 1995.

SECTION 4. Emergency clause.
