BACKGROUND
The General Land Office is not currently required to sell two
state-owned lots located in San Antonio.
PURPOSE
As proposed, S.B. 956 requires the General Land Office to convey
certain tracts of state-owned real property in Bexar County.
RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not grant any
additional rulemaking authority to a state officer, institution, or
agency.
SECTION BY SECTION ANALYSIS
SECTION 1. CONVEYANCE REQUIRED. Authorizes the General Land Office
to convey the state's interest in the real property described by
Section 2 of this Act.
SECTION 2. PROPERTY DESCRIPTION. Subjects lot 10, block 2, new
city block 589 and the north 45 feet of the south 95 feet of lots
11 and 12, block 2, new city Block 589, both in the City of San
Antonio, Bexar County, to this Act.
SECTION 3. TERMS AND CONDITIONS OF SALE. (a) Requires the General
Land Office to convey the property in the manner prescribed by
Section 31.158, Natural Resources Code. Authorizes the property to
be sold in whole or in part.
(b) Provides that an owner of land with a boundary common to
the tract has, with respect to the tract to which the owner's
property adjoins, a preference right to purchase the tract
before it is made available for sale to another person.
Provides that each person entitled to a preference has an
equal preference.
(c) Prohibits a person entitled to a preference from
purchasing the tract for less than the tract's market value.
SECTION 4. Emergency clause.
Effective date: upon passage.
