BACKGROUND

Currently, persons as young as 15 years old are allowed to receive
a motorcycle license with a moped restriction.  No training
prerequisite exists in order to obtain this license.  Elimination 
of the moped class of vehicle would require all individuals to
complete a driver's education course in order to operate a motor
vehicle.

PURPOSE

As proposed, C.S.S.B. 994 includes a moped as a class of motorcycle
or motor-driven cycle subject to all limitations and requirements.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not grant any
additional rulemaking authority to a state officer, institution, or
agency.

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 1(c), Article 6675a-1, V.T.C.S., to
redefine "motorcycle."

SECTION 2. Amends Section 3(a), Article 6675a-3, V.T.C.S., to
require the registration for a motorcycle, motor-driven cycle, or
moped to include the engine cubic centimeter piston displacement,
among other information.

SECTION 3. Amends Section 24, Article 6687-1, V.T.C.S. (Certificate
of Title Act), to redefine "certificate of title."
SECTION 4. Amends Section 12(e), Article 6687b, V.T.C.S., to
require a written examination concerning the rules of the road
applicable to the operation of mopeds.  Provides that for minors
wishing to receive a moped only license, the motorcycle operator
training requirements previously outlined for motorcycles and
motor-driven cycles apply.  Requires an individual to successfully
complete a road test on a motorcycle or motor-driven cycle in order
to upgrade a moped only license to a motorcycle license.  Requires
the Department of Public Safety (DPS) to require manufacturers,
distributors, importers, and retailers of motorcycles, motor-driven
cycles, and mopeds to certify to DPS the cc piston displacement of
all such vehicles offered for sale and to be titled and registered
in the state.  Requires certification to be made by including the
cc piston displacement on the manufacturer's certificate or other
document to be prescribed by DPS for purposes of showing original
transfer of a new motorcycle, motor-driven cycle, or moped from the
manufacturer to other purchaser.  Requires the word moped to be
included on all manufacturer's certificates and certificate of
title and registration for vehicles that conform to the definition
of moped in Section 2(n), Article 6701d, V.T.C.S.  Deletes existing
Subdivisions (2)-(3).  Makes conforming and nonsubstantive changes.

SECTION 5. Amends Section 2(c), Article 6701d, V.T.C.S., to
redefine "motorcycle."

SECTION 6. Effective date: September 1, 1995.

SECTION 7. Emergency clause.
