BACKGROUND

In Houston, a firefighter or police officer has a right to get a
copy of his or her supervisor's response to a grievance within five
of the supervisor's working days.  There is a potential for
confusion and inequity since different supervisors have different
work schedules.

PURPOSE

As proposed, S.B. 1015 sets forth a deadline for fire and police
grievance procedures in certain municipalities.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not grant any
additional rulemaking authority to a state officer, institution, or
agency.

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 143.128(d), Local Government Code, to
require a firefighter's or police officer's immediate supervisor to
provide a written response to a grievance by a firefighter or
police officer, with a copy to the grievance counselor, within 15
calendar days, rather than five of the supervisor's working days,
after the date of a Step I grievance meeting, regardless of the
outcome of the meeting.

SECTION 2. Amends Sections 143.129(a), (b), and (c), Local
Government Code, to make conforming changes.

SECTION 3. Amends Sections 143.130(a) and (d), Local Government
Code, to make conforming changes.

SECTION 4. Amends Section 143.131(a), Local Government Code, to
make a conforming change.

SECTION 5. Effective date:  September 1, 1995.
           Makes application of this Act prospective.

SECTION 6. Emergency clause.
     

SUMMARY OF COMMITTEE ACTION

SB 1015 was considered by the committee in a public hearing on
April 24, 1995.  The following people testified in favor of the
bill: Rep. Torres.  The bill was reported favorably without
amendment, with the recommendation that it do pass and be printed
and be sent to the Committee on Local and Consent Calendars, by a
record vote of 7 ayes, 0 nays, 1 pnv, and 1 absent.
