BACKGROUND

The George Bush Presidential Library Center, now under construction
on the Texas A&M University campus in College Station, is expected
to open in 1997.  In addition to serving as a document repository
for the Bush administration, the center will support a new George
Bush School of Government and Public Service as well as Centers for
Presidential Studies and Public Leadership Studies.

Current statute does not provide for the location of a cemetery on
state property unless specifically authorized by the legislature. 
In order for the former president, his wife, and their immediate
family to be buried on the grounds of the Bush Presidential Library
Center, specific authorization is necessary.

PURPOSE

As proposed, S.B. 1018 authorizes the Board of Regents of the Texas
A&M University System to dedicate the land owned by the system
within the Bush Presidential Library site to be used as a cemetery.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not grant any
additional rulemaking authority to a state officer, institution, or
agency.

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Chapter 86B, Education Code, by adding Section
86.24, as follows:

     Sec. 86.24.  ESTABLISHMENT OF A CEMETERY.  (a) Authorizes the
     Board of Regents of the Texas A&M University System to
     dedicate the land owned by the system within the Bush
     Presidential Library site to be used as a cemetery.
     
     (b) Provides that Chapter 711C, Health and Safety Code, does
       not apply to a cemetery established under this section.
       
       (c) Prohibits appropriations from the general revenue fund
       from being used to establish or operate a cemetery under
       this section.
     SECTION 2.     Emergency clause.
           Effective date: upon passage.
