BILL ANALYSIS S.B. 1020 By: Brown (Allen) 5-18-95 Committee Report (Unamended) BACKGROUND In 1991, the 72nd Legislature created the Office of Immigration and Refugee Affairs, the Health and Human Services Transportation and Planning Office and the Automobile Theft Prevention Authority within the governor's office. PURPOSE S.B. 1020 transfers the Office of Immigration and Refugee Affairs, the Health and Human Services Transportation and Planning Office, and the Energy Office from the governor's office to specific state agencies. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Sections 752.001 and 752.003, Government Code, as follows: Sec. 752.001. OFFICE OF IMMIGRATION AND REFUGEE AFFAIRS. Provides that the Office of Immigration and Refugee Affairs is created within the Texas Department of Human Services, rather than the governor's office. Sec. 752.003. REFUGEE COORDINATOR. Requires the refugee coordinator to serve as chief administrative office of the office and to ensure coordination of public and private resources in refugee resettlement. SECTION 2. Repealer: Section 752.002, Government Code (Executive Director). SECTION 3. Amends Chapter 131, Human Resources Code, as follows: CHAPTER 131. HEALTH AND HUMAN SERVICES TRANSPORTATION AND PLANNING OFFICE Sec. 131.001. OFFICE. Provides that the Health and Human Services Transportation and Planning Office is in the Health and Human Services Commission, rather than the governor's office. Sec. 131.002. POWERS AND DUTIES establishes the powers and duties of the office. Sec. 131.003. OFFICE STAFF. Requires the commissioner of Health and Human Services, rather than the governor, to employ staff. SECTION 4. Amends Section 2305.002(3), Government Code, to amend the definition of "energy office" as the energy office of the General Commission rather than the governor's office. SECTION 5. Amends Section 2305.011, Government Code, as follows: Sec. 2305.011. New heading: ADMINISTRATION BY GOVERNOR AND ENERGY OFFICE. (a)-(b) No change. (c) Deletes Subdivision (3) requiring federal guidelines. (d) Requires the energy office to send to the appropriate federal entity all information required under applicable federal guidelines. (e) Redesignated from existing Subsection (d). SECTION 6. Amends Section 2305.037, Government Code, to provide that the energy office is the supervising state agency, which shall administer the Native American restitutionary program. Makes a conforming change. SECTION 7. Amends the heading of Chapter 447 and Section 447.001, Government Code, as follows: CHAPTER 447. New heading: ENERGY MANAGEMENT CENTER Sec. 447.001. ESTABLISHMENT OF CENTER. Provides that the energy management center is established in the General Services Commission rather than in the governor's office. SECTION 8. Amends Sections 447.004(a), (c), and (d), Government Code, to make conforming and nonsubstantive changes. SECTION 9. Amends Sections 447.005-007, Government Code, to make conforming changes. SECTION 10. Amends Section 447.008(a), Government Code, to make conforming and nonsubstantive changes. SECTION 11. Amends Section 447.011(a), Government Code, to make conforming and nonsubstantive changes. SECTION 12. Effective date: September 1, 1995. SECTION 13. Emergency clause. Effective date: upon passage.
